Julianne R. Frank

 

Ms. Frank is the senior partner at Frank, White-Boyd, P.A. Her practice focuses on bankruptcy law, financial distress and asset protection planning. She is nationally certified by the American Board of Certification in both consumer and business bankruptcy, one of only 150 attorneys in the United States with such a certification.

Ms. Frank has 30 years of experience representing debtors, both individual and business, and has successfully orchestrated the restructuring and reorganization of business entities of myriad diversity – including airlines, construction companies, restaurants, software development companies, retail operations, homeowner association, agricultural concerns and medical practices. She actively represents banks, governmental entities and other creditors in bankruptcy proceedings. In representing bankruptcy trustees, she has successfully pursued the recovery of substantial funds for bankruptcy estates.

Ms. Frank has extensive experience in bankruptcy adversary proceedings and has prevailed against such adversaries as the Internal Revenue Service and opposing bankruptcy trustees. Her cases have resulted in published and game-changing case law.

Her practice has also led to comprehensive knowledge and experience in the arena of post-judgment collections, judgment enforcement and domestic and offshore asset protection planning.

Nationally recognized for her exemplary skills and knowledge in bankruptcy and asset protection, Ms. Frank lectures extensively to lawyers, accountants and bankers regarding the expanded recognition of financial distress and related planning and aversion techniques.

 

Ms. Frank has also been interviewed on numerous national radio and television broadcasts discussing financial distress issues.

Ms. Frank is an active supporter of the community and charitable causes, and is heavily involved in promoting bankruptcy education for the legal and professional community. She recently chaired a fundraising drive for the Pediatric AIDS Foundation, served on the Board of Directors of Children’s Hope and assisted in the Hurricane Katrina reconstruction efforts. She also inaugurated the Adult Space Camp program at the NASA facility in Huntsville, Ala., and is an acting President of the Tulane University Alumni. Ms. Frank lectures regularly for several national organizations offering continuing education programs on bankruptcy and financial distress issues.

Originally from Rochester, N.Y., Ms. Frank resides in Jupiter, Fla., where she pursues her passions of sailing, screenwriting and the culinary arts.

Nadine V. White-Boyd

 

 

Ms. White-Boyd has over 16 years legal experience, focusing her practice on bankruptcy and real estate transactions (closings, Title Agent). Nadine represents small businesses and individuals, dedicating herself to helping clients rebuild their financial lives.

Born in Jamaica, Ms. White-Boyd and her family moved to New York when she was a freshman in high school.

Ms. White-Boyd has extensive bankruptcy experience. On the creditor side, she worked in the bankruptcy department of a large mortgage servicer corporation. She also served as a compliance attorney for a nationwide law firm providing legal guidance to the bankruptcy and loss mitigation departments of the firm’s clients. This gave Ms. White-Boyd invaluable insight into the creditors’ perspective of litigation and negotiations.

Desiring a change from the corporate environment, Ms. White-Boyd went into private practice and has represented numerous individual and business debtors.

Whether she is representing the creditor or the debtor, her clients have the advantage of a well-versed attorney who serves as a zealous advocate in their cases.

Within the scope of her practice, Ms. White-Boyd:

  • Represents individuals and businesses in Chapter 7, 11 and 13 bankruptcy petitions;

Larry A. Strauss

 

Mr. Strauss has considerable experience representing individuals and businesses in an assortment of litigation matters. Examples of matters Mr. Strauss handles include:

  • Commercial and real estate litigation: Including business disputes, assisting clients with strategies for minimizing litigation risks, escrow disputes, breaches of listing agreements, mold litigation, or breaches of contracts for purchase and sale;
  • Employment law: Counseling employers on workplace compliance and employee termination issues, drafting releases, responding to complaints/pleadings, and defending overtime compensation claims under the Fair Labor Standards Act;
  • Bankruptcy matters: Representation of creditors in filing proofs of claims and adversary proceedings;
  • Foreclosures: Defense of foreclosure matters;
  • Intellectual property matters: Preparation and filing of trademark applications and shepherding them through final registration, including replies to any objections raised by U.S. Patent & Trademark Office or Florida examiners; helping companies contend with cybersquatting of company domains and managing the resulting transfers of the infringing domains per settlements;

A representative sampling of Mr. Strauss’s past cases includes:

  • Lead attorney in representing a national, corporate creditor in a Chapter 7 adversary proceeding regarding multi-million dollar claims involving fraudulent transfers. The matter resolved at mediation, with awards of costs, attorney’s fees, experts’ fees and a substantial payment on the client’s proof of claim;
  • Resolution of a dispute (without having to file suit) regarding an easement for a 10-foot strip of land that was delaying construction on a major condominium project in Palm Beach County. The matter involved a 60-year-old defect in the title history and apparent fraud by a trustee;
  • Lead attorney in representing a national credit card processing company in obtaining a $353,000 carve-out from a bankruptcy estate in a Chapter 11 proceeding, with said sum ordered held in escrow to protect the company from potential chargebacks;
  • Defense of foreclosure matters, including one which resulted in a lender write-off in excess of $120,000;
  • Success in a dispute with a national health insurer regarding insurance coverage for the cost of Viagra for a female client as off-label use to treat severe pulmonary hypertension;
  • Counseling a major Florida corporation in its handling of company e-mail address “spoofing” and the resulting solicitations of employees by a former employee;
  • Prevailing on behalf of a corporate client in assisting with the elimination of a so-called “gripe site,” wherein someone uses free speech as a basis for creating a “companysucks.com” domain to post negative comments about the company.

Prior to his legal career, Mr. Strauss was a journalist for nine years at a number of well-known Florida and national newspapers, including USA Today, The Miami-Herald, The Gainesville Sun, South Florida Business Journal and The News-Press.

Mr. Strauss is a Florida native, born in Miami and now residing in Palm Beach County.

Malinda Hayes

 

Ms. Hayes is a graduate of Florida State University College of Law, graduating in the top 5% of her class. She was highly involved in the Florida State University Law Review, serving as Associate Articles Editor and Social Chair.
 
• Before attending law school, Ms. Hayes graduated with a B.A. from University of Washington and studied International Law at Oxford University.
 
• She has a background in Bankruptcy Law, serving as a Term Law Clerk for the past year to the Honorable J. Rich Leonard for the United States Bankruptcy Courts, Eastern District of North Carolina. In this role, she drafted and edited orders and opinions to the Court, researched, analyzed and discussed legal issues with Judge Leonard, reviewed pleadings and prepared case summaries for use during hearings.
 
After her clerkship, Ms. Hayes gained experience in the areas of bankruptcy and creditor's rights as an associate at Broad and Cassel.
 
 
• Serving as a Summer Associate for a National law firm with offices in 5 states, Ms. Hayes focused on construction litigation, employment law and foreclosures.
Broadening her legal experience, Ms. Hayes also has served as an office manager and paralegal in a small law firm in Washington; creating,
implementing and maintaining bookkeeping and filing systems, maintaining client relations and composing correspondence and pleadings.
 
• Ms. Hayes is fluent in French.
 
Ms. Hayes is active in various professional and community organizations, including serving as a Volunteer Income Tax Preparer for Volunteer Income Tax Assistance (VITA). She has also assisted domestic violence victims with family law and social issues.
